29 CFR  1910.132(a): Application. Protective equipment, including personal protective equipment for eyes, face, head, and extremities, protective clothing, respiratory devices, and protective shields and barriers, shall be provided, used, and maintained in a sanitary and reliable condition wherever it is necessary by reason of hazards of processes or environment, chemical hazards, radiological hazards, or mechanical irritants encountered in a manner capable of causing injury or impairment in the function of any part of the body through absorption, inhalation or physical contact.  Tank 14:  On or about June 5, 2024,  employees dumping bags of raw material into vessel 14 were exposed to explosion and fire hazards from combustible dusts, such as, but not limited to, Tertiary Butyl Hydroquinone also known as TBHQ.  The employer failed to provide protective equipment, such as, but not limited to, flame resistant clothing, to employees when exposed to flash fire hazards in tank 14.  Abatement documentation is required for this item in accordance with the requirements of 29 CFR 1903.13(d).

Employers shall select and require employees to use appropriate hand protection when employees' hands are exposed to hazards such as those from skin absorption of harmful substances; severe cuts or lacerations; severe abrasions; punctures; chemical burns; thermal burns; and harmful temperature extremes.  Tank 14: On or about June 5, 2024, employees dumping bags of raw material into vessel 14 were exposed to explosion and fire hazards from combustible dusts such as, but not limited to, Tertiary Butyl Hyroquinone also known as TBHQ. The employer failed to select and require employees to use appropriate hand protection when employees' hands are exposed to hazard such as those from harmful temperature extremes.    Abatement documentation is required for this item in accordance with the requirements of 29 CFR 1903.13(d).

29 CFR 1910.134(c)(1): In any workplace where respirators are necessary to protect the health of the employee or whenever respirators are required by the employer, the employer shall establish and implement a written respiratory protection program that included the provisions in 29 CFR 1910.134(c)(1)(i)-(ix) with worksite-specific procedures:  Vessel/Tank 14:  On or about June 5, 2024, the employer did not develop and implement a written respiratory protection program with worksite specific procedures for respirator use that included all provisions in 29 CFR 1910.134(c)(1)(i)-(ix).  The employer required employees to wear respirators while exposed to respiratory and combustible hazards from dusts such as Tertiary Butyl Hydroquinone (TBHQ) in vessel 14.  The employees were required to wear respirators, Honeywell, North Air Purifying  RU6500 Full Face Respirator Series, to protect from the airborne hazards.  Abatement documentation is required for this item in accordance with the requirements of 29 CFR 1903.13(d).

Equipment, wiring methods, and installations of equipment in hazardous (classified) locations shall be intrinsically safe, approved for the hazardous (classified) location, or safe for the hazardous (classified) location.  Tank 14-On or about June 5, 2024, electrical equipment including, but not limited to, overhead lights, circuit breaker panels, and the flanged immersion heater, in Class II Division I location was not intrinsically safe and approved for a  Class II, Division I or safe for a Class II Division I location.    Abatement documentation is required for this item in accordance with the requirements in 29 CFR 1903.19(d).

Labels and other form of warning; 2.  Safety data sheets; 3.  Employee information and training 4.  Methods to inform employees of the hazards on non routine tasks;  Tank 14:  On or about June 5, 2024, employees dumping bags of raw material into vessel 14 were exposed to explosion and fire hazards from combustible dusts such as, but not limited to, Tertiary Butyl Hydroquinone also known as TBHQ.  The employer did not develop, implement, and or  maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910. 1200 (f), (g), and (h) of this section for labels and other forms of warning, safety data sheets, and employee information and training will be met.    Abatement documentation is required for this item in accordance with the requirements of 29 CFR 1903.19(d).
