29 CFR 1926.1053(b)(1): When portable ladders are used for access to an upper landing surface, the ladder side rails shall extend at least 3 feet (.9 m) above the upper landing surface to which the ladder is used to gain access; or, when such an extension is not possible because of the ladder's length, then the ladder shall be secured at its top to a rigid support that will not deflect, and a grasping device, such as a grabrail, shall be provided to assist employees in mounting and dismounting the ladder. In no case shall the extension be such that ladder deflection under a load would, by itself, cause the ladder to slip off its support. On or about 6/25/2024, at a work-site located at 1429 Stone Crossing ST NE, Canton Ohio 44721 the employer did not ensure that a ladder used for accessing the roof of a residential structure extended at least 3 feet beyond the upper landing surface and/or was secured at the top with a grasping device, exposing employees to falls over 10.8 feet. Miller Brothers Roofing was previously cited for a violation of this occupational safety and health standard or its equivalent standard (1926.1053(b)(1) Ladders), which was contained in OSHA inspection number 1603558, citation number 1, item number 01 and was affirmed as a final order on (8/16/2022), with respect to a workplace located at 8990 Elsmere DR, Parma Ohio 44130. Miller Brothers Roofing was previously cited for a violation of this occupational safety and health standard or its equivalent standard (1926.1053(b)(1) Ladders), which was contained in OSHA inspection number 1413661, citation number 01, item number 02 and was affirmed as a final order on (10/21/2019), with respect to a workplace located at 6007 Highpoint DR, Medina Ohio 44256.
