29 CFR 1910.95(c)(1):The employer did not administer a continuing, effective hearing conservation program as described in 29 CFR 1910.9(c) through (o) whenever employee noise exposures equal or exceed an 8-hour time-weighted average sound level of 85 decibels measured on the A scale, or equivalently a dose of fifty percent: (a) Marty Gilman, Inc, 30 Gilman Road, Gilman, CT 06336; On or about June 26, 2024, and at times prior, employees working the grinding and polishing machines were exposed to 87.6 dBA or 72.0% Dose over the sampled 7.5-hour work shift. The Action Limit for noise exposure, adjust for an 8-hour work shift, is 87 dBA or 66% Dose (corrected for a 2dBA instrument error) which was exceeded in the grinding and polishing area. The employer did not administer a hearing conservation program that included the requirements described in paragraphs (c) through (o) of the section.

29 CFR 1910.1200(e)(1):Employer had not developed or implemented a written hazard communication program that included the requirements outlined in 29 CFR 1910.1200(e)(1)(i) and (e)(1)(ii): (a) Marty Gilman, Inc, 30 Gilman Road, Gilman, CT 06336, Welding areas; On or about June 26, 2024, and at times prior the employer had not implemented a written hazard communication program to include information associated with hazards from exposure to heavy metals during welding operations. Exposure to these chemicals can cause metal fume fever, lung disease, and is potentially carcinogenic. (b) Marty Gilman, Inc, 30 Gilman Road, Gilman, CT 06336, Molding Room; On or about June 26, 2024, and at times prior the employer had not implemented a written hazard communication program to include information associated with hazards from exposure to and polyol resin and diphenylmethane -4,4;-diisocyanate (MDI) mixture from the molding room. Exposure to this chemical combination is known to have specific target organ toxicity both for single exposure and repeated exposure, is suspected to be cancer causing, and has reproductive toxicity.
