29 CFR OSH ACT of 1970 Section (5)(a)(1): Section 5(a)(1) of the Occupational Safety and Health Act: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were not protected from the hazard of being struck-by or caught-in between operating motor vehicles and equipment: a) 2114 Shipley Rd., Wilmington, DE 19810 (southbound side): On or about June 26, 2024, Employees were exposed to multiple hazards onsite including but not limited to struck by/caught in hazards when they traversed back and forth across Shipley Rd., Wilmington Delaware North and Southbound bound to facilitate operations without the use of a properly communicated traffic control plan and internal traffic control plan. b) a) 2114 Shipley Rd., Wilmington, DE 19810 (southbound side): On or about June 26, 2024, employees were exposed to multiple hazards onsite including but not limited to struck-by and caught-in hazards while performing driveway replacement/repaving activities while crossing live lanes of Shipley Road without a ANSI/ISEA 107 approved high visibility vest. The employer failed to ensure that the high visibility vest was worn on the outer garment that resulted in exposure to struck by or caught in between hazards.

29 CFR 1926.200(g)(1): Construction areas were not posted with legible traffic signs at points of hazards: a) 2114 Shipley Rd., Wilmington, DE 19810 (North and southbound side): On or about June 26, 2024, signs were not visible to the public while traveling North and South on Shipley Road to assist traffic in understanding traffic pattern changes due to residential driveway repaving work as stated in the MUTCD Section 6G.03. This exposed employees to multiple hazards onsite including but not limited to struck by/ caught in hazards when they performed driveway replacement/repaving work.

Temporary traffic barriers used did not conform to provide protection for the equipment and employees. Company vehicles were observed exposed when the channeling devices did not fully enclose the work area according to Section 6C.08.
