29 CFR 1926.501(b)(1): Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems. (A) On June 26, 2024, at the construction site located at the corner of Fleetwood Drive and S 42nd St, Grand Forks, ND, employees conducting framing on a 4-story apartment were exposed to falls of greater than 6 feet when guard rails protecting a second story landing were removed. (B) On June 26, 2024, on the second-floor stair landing of the construction site located at the corner of Fleetwood Drive and S 42nd St, Grand Forks, ND, employees conducting framing on a 4-story apartment were exposed to falls of greater than 6 feet when an opening that was 24" wide was not protected. (C) On June 26, 2024, on the fourth-floor stair landing of the construction site located at the corner of Fleetwood Drive and S 42nd St, Grand Forks, ND, employees conducting framing on a 4-story apartment were exposed to falls of greater than 6 feet when an opening at the stair landing was not protected.

29 CFR 1926.502(b)(1): Top edge height of top rails, or equivalent guardrail system members, were not 42 inches (1.1 m) plus or minus 3 inches (8 cm) above the walking/working level: (A) On June 26, 2024 and times prior, at the construction site located at the corner of Fleetwood Drive and S 42nd St, Grand Forks, ND a guard rail located in a window opening on the north side of the second floor had a top edge height of 58 inches exposing employees to a fall greater than 6 feet while conducting framing activity.
