29 CFR  1926.760(a)(1): Each employee engaged in a steel erection activity who is on a walking/working surface with an unprotected side or edge more than 15 feet (4.6 m) above a lower level was not protected from fall hazards by guardrail systems, safety net systems, personal fall arrest systems, positioning device systems, or fall restraint systems.   On or about June 26, 2024, Employees were exposed to fall hazards in approximately 18 feet while engaged in steel roofing activities. Fall protection was not being utilized while employees were engaged in metal  roof installation and activities.  No abatement certification or documentation is required for this item.

29 CFR  1926.761(b): The employer shall train each employee exposed to a fall hazard in accordance with the requirements of 29 CFR 1926.761. The employer shall institute a training program and ensure employee participation in the program. The program shall include training and instruction in the following areas: (1) The recognition and identification of fall hazards in the work area; (2) The use and operation of guardrail systems (including perimeter safety cable systems), personal fall arrest systems, positioning device systems, fall restraint systems, safety net systems, and other protection to be used; (3) The correct procedures for erecting, maintaining, disassembling, and inspecting the fall protection systems to be used; (4) The procedures to be followed to prevent falls to lower levels and through or into holes and openings in walking/working surfaces and walls; and (5) The fall protection requirements of this subpart.   On or about June 26, 2024, the employer did not certify that employees had been trained to recognize and minimize fall hazards. Employees were exposed to fall hazards in approximately 18  feet while performing metal roofing activities without using fall protection.   Abatement certification is required for this item in accordance with 29 CFR 1903.19(c).

29 CFR 1926.453(b)(2)(v): A body belt was not worn and/or a lanyard was not attached to the boom or basket when working from an aerial lift:Note:  As of January 1, 1998, subpart M of this part (1926.502(d)) provides that body belts are not acceptable as part of a personal fall arrest system.  The use of a body belt in a tethering system or in a restraint system is acceptable and is regulated 1926.502(e).   On or about June 26, 2024, employees were performing metal roofing operations on roof of  a commercial property using a SkyJack SJ45T aerial lift and were exposed to fall hazards approximately 18 feet when the employer failed to ensure that fall protection was utilized.  No abatement certification or documentation is required for this item.  Southern Heritage Construction, Inc was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.453(b)(2)(v), which was contained in OSHA inspection number 1429520, citation number 2 item number 1 and was affirmed as a final order on October 23, 2019, with respect to a workplace located at Eljadid St., Morgantown, WV, 26505.
