29 CFR 1926.20(b)(2): The employer did not initiate and maintain a safety program which provides for frequent and regular inspections of jobsites, materials, and equipment to be made by a competent person who is capable of identifying existing and predictable hazards in the surroundings or working conditions which are unsanitary, hazardous, or dangerous to employees, and who has the authority to take prompt corrective measures to eliminate them:  (a)NewGen Framing, LLC at 3500 South Linedrive Avenue, Sioux Falls, SD 57110: On or about and at times prior to June 26, 2024, the exposing employer did not ensure an accident prevention program was developed and implemented for the work environment to include regular inspections of the jobsite, materials, and equipment; conducted by a competent person. Employees were conducting framing operations on a multi-family residential property without the use of a fall protection system, improper use of a fall protection system, a lack of use of eye protection while using pneumatic nail guns, using incorrectly installed extension ladders, and a lack of training documentation.  This condition exposed employees to a variety of hazards while working on site.

29 CFR 1926.102(a)(1): The employer did not ensure that each affected employee used appropriate eye or face protection when exposed to eye or face hazards from flying particles:  (a)NewGen Framing, LLC at 3500 South Linedrive Avenue, Sioux Falls, SD 57110: On or about and at times prior to June 26, 2024, the exposing employer did not ensure that each employee that was installing roof truss systems on a multi-family residential property with the use of a pneumatic nail guns were protected from flying particles by the use of appropriate eye protection.  This condition exposed employees to struck-by hazards.

This condition exposed employees to fall hazards.
