29 CFR 1926.20(b)(2): The employer did not initiate and maintain a safety program which provides for frequent and regular inspections of jobsites, materials, and equipment to be made by a competent person who is capable of identifying existing and predictable hazards in the surroundings or working conditions which are unsanitary, hazardous, or dangerous to employees, and who has the authority to take prompt corrective measures to eliminate them:  (a)BCM Construction & Roofing, LLC at 411 Honeysuckle Drive, Harrisburg, SD 57032: On or about and at times prior to June 27, 2024, the exposing employer did not ensure an accident prevention program was developed and implemented for the work environment to include regular inspections of the jobsite, materials, and equipment; conducted by a competent person. Employees were conducting roofing operations on a multi-family residential property without the use of a fall protection system, a lack of use of eye protection while using pneumatic nail guns, using incorrectly installed multi-purpose ladders, and a lack of training documentation.  This condition exposed employees to a variety of hazards while working on site.

29 CFR 1926.102(a)(1): The employer did not ensure that each affected employee used appropriate eye or face protection when exposed to eye or face hazards from flying particles:  (a)BCM Construction & Roofing, LLC at 411 Honeysuckle Drive, Harrisburg, SD 57032: On or about and at times prior to June 27, 2024, the exposing employer did not ensure that each employee that was installing roof shingles on a multi-family residential property with the use of a pneumatic nail gun were protected from flying particles by the use of appropriate eye protection.  This condition exposed employees to struck-by hazards.

This condition exposed the employees to fall hazards greater than six feet.

29 CFR 1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladders' side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed:  (a)BCM Construction & Roofing, LLC at 411 Honeysuckle Drive, Harrisburg, SD 57032: On or about and at times prior to June 27, 2024, the exposing employer did not ensure that the 10 foot Keller Aluminum Multi-purpose ladder that the employees were using was extended at least three feet above the upper landing surface of the garage roof eave of a multi-family residential building.  This condition exposed employees to fall hazards.
