29 CFR 1910.147(c)(1): Energy control program. The employer shall establish a program consisting of energy control procedures, employee training and periodic inspections to ensure that before any employee performs any servicing or maintenance on a machine or equipment where the unexpected energizing, startup or release of stored energy could occur and cause injury, the machine or equipment shall be isolated from the energy source and rendered inoperative.  On or about June 27, 2024, at location W4892 County Road O, Appleton, Wisconsin: employer failed to develop and document a Hazardous Energy Control Program to include energy control procedures, employee training, and periodic inspections when employees were performing servicing and maintenance activities on the Sierra REB-2 Two Ram Baler (Model: REB-2-LH-250, Serial: 3041).

29 CFR 1910.157(g)(1): Where the employer has provided portable fire extinguishers for employee use in the workplace, the employer shall also provide an educational program to familiarize employees with the general principles of fire extinguisher use and the hazards involved with incipient stage firefighting.  On or about April 22, 2024, at location W4892 County Road O, Appleton, Wisconsin: the employer failed to provide training to familiarize employees with general principles of fire extinguisher use and the hazards associated with incipient stage firefighting, exposing employees to potential thermal injuries. A fire had occurred on the Vermeer Horizontal Grinder (model: HG6000, VIN: 1VRY40315C1001039) where employees had to respond and use fire extinguisher to put out the fire.

On or about June 27, 2024, at location W4892 County Road O, Appleton, Wisconsin: employees were exposed to hazards related to forklift operations while utilizing forklifts that were missing the data plate.  a) Employees operating a CAT Forklift (Model: 2C6000, Serial: AT83F41707) did not have the required manufactures data plate on it with regards to load capacities.   b) Employees operating a CAT Forklift (Model: 2C6000, Serial: AT83F40477) did not have the required manufactures data plate on it with regards to load capacities.

29 CFR 1910.178(p)(1): If at any time a powered industrial truck is found to be in need of repair, defective, or in any way unsafe, the truck shall be taken out of service until it has been restored to safe operating condition.   On or about June 27, 2024, at location W4892 County Road O, Appleton, Wisconsin: employees operated powered industrial trucks with damage including, but not limited to, chunks of tire missing, severe splitting of tire sidewalls and tires pulling away from the rims.  a) #7 CAT Forklift (Model: 2C6000, Serial: AT83F41707) was operated with damaged tires. Damage to the tires was found to include, but was not limited to, severe chunks missing and tires pulling away from the rims, which could result in the tires to lose traction and possibly expose forklift operators to tip-over hazards.  b) #4 Mitsubishi (Model: FGC30N, Serial: AF83F40669) was operated with damaged tires. Damage to the tires was found to include, but was not limited to, severe chunks missing and tires pulling away from the rims, which could result in the tires to lose traction and possibly expose forklift operators to tip-over hazards.

29 CFR  1910.178(q)(7):Industrial trucks shall be examined before being placed in service and shall not be placed in service if the examination shows any condition adversely affecting the safety of the vehicle. Such examination shall be made at least daily. Where industrial trucks are used on a round-the-clock basis, they shall be examined after each shift. Defects when found shall be immediately reported and corrected. Examples of guarding methods are-barrier guards, two-hand tripping devices, electronic safety devices, etc.  On or about June 27, 2024, at location W4892 County Road O, Appleton, Wisconsin: employees were exposed to potential hazards associated with moving machine parts when working near Sierra REB-2 Two Ram Baler (Model: REB-2-LH-250, Serial: 3041) when interlocked doors for the cage around the wire tier was removed with the interlocks bypassed while the machine was running in a production capacity.
