NOTE: Proper application of the decision flow chart in Appendix A to section 1910.146 would facilitate compliance with this requirement. a) On or about July 22, 2024, at the establishment located at 3107 Fricke Drive, Manitowoc, Wisconsin; the employer did not properly evaluate the workplace to determine if the barrel of a concrete mixer was a permit-required confined space, exposing an employee to the hazards associated with permit-required confined space hazards, such as but not limited to struck against a rotating barrel.

29 CFR 1910.1053(d)(1): The employer shall assess the exposure of each employee who is or may reasonably be expected to be exposed to respirable crystalline silica at or above the action level in accordance with either the performance option in paragraph (d)(2) or the scheduled monitoring option in paragraph (d)(3) of 29 CFR 1910.1053 a) On or about July 22, 2024, at the establishment located at 3107 Fricke Drive, Manitowoc, Wisconsin; the employer did not assess employee exposure to respirable crystalline silica while an employee was removing concrete from the inside of the barrel of a concrete mixer using a pneumatic jackhammer, exposing an employee to the hazards associated with respirable crystalline silica.
