29 CFR 1910.134(c)(1): A written respiratory protection program that included the provisions in 29 CFR 1910.134(c)(1)(i) - (ix) with worksite specific procedures was not established and implemented for required respirator use:  a) 29444 E Hwy 160, Durango, CO 81303: On or about June 26, 2024, and at times prior, the employer did not establish a written respiratory protection program.  Employees were required to use tight-fitting half face respirators for production tasks including but not limited to when dry cutting stone and using angle grinders on slabs. Stone cutting and grinding may result in exposure to respirable crystalline silica, a carcinogen whose health effects also include silicosis, and Chronic obstructive pulmonary disease (COPD).

29 CFR 1910.184(f)(5)(i): Wire rope sling(s) that had ten or more randomly distributed broken wires in one rope lay, or five or more broken wires in one strand in one rope lay, were not immediately removed from service:  a) 29444 E Hwy 160, Durango, CO 81303: On or about June 26, 2024, and at times prior, employees used a slab lifting clamp attached to a forklift mounted jib boom via a wire rope sling which had ten distributed broken wires, to lift and move stone slabs.  This condition exposed employees to crushed-by and caught-between injuries.

The angle grinder did not have a guard and was exposed to water while cutting, thereby exposing employees to potential injury from flying particles, debris, and shock.

The forklift had not been marked for use with the jib attachment.
