29 CFR  1926.651(c)(2):A stairway, ladder, ramp or other safe means of egress was not located in trench excavations that were 4 feet (1.22m) or more in depth so as to require no more than 25 feet (7.62m) of lateral travel for employees:  a) On or about July 1, 2024, at the jobsite: the employer allowed employees to work in an excavation without a stairway, ladder, ramp or other safe means of egress located in the excavation 60' long x 25' wide and 7' deep on the east side and 10' deep on the west side, with near vertical walls, in class C soil, exposing employees to crushing hazards.

29 CFR  1926.651(j)(2):Protection was not provided by placing and keeping excavated or other materials or equipment at least 2 feet (.61m) from the edge of excavations, or by the use of retaining devices that were sufficient to prevent materials or equipment from falling or rolling into excavations, or by a combination of both if necessary.  a) On or about July 1, 2024, at the jobsite: the employer allowed employees to work in an excavation without the excavated materials at least 2 feet from the edge of an excavation 60' long x 25' wide and 7' deep on the east side and 10' deep on the west side, with near vertical walls, in class C soil, exposing employees to crushing and struck by hazards.

29 CFR  1926.1053(b)(16):Portable ladders with structural defects, such as, but not limited to, broken or missing rungs, cleats, or steps, broken or split rails, corroded components, or other faulty or defective components, were not either immediately marked in a manner that readily identifies them as defective, or tagged with "Do Not Use" or similar language, and were not withdrawn from service until repaired.  a) On or about July 1, 2024, at the jobsite: employees were exposed to a 7 foot fall hazard while accessing and egressing the reclaim # 3 concrete tank 13' long 7' wide and 7' tall, inside the excavation on the east side, in that, the employer allowed employees to use a defective ladder which was missing its top rung.
