OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to excessive heat while working outdoors. a) On July 02, 2024, and at times prior, employees were exposed to the hazard of high ambient heat from direct sun during the performance of their job duties, including framing a 3,030 square foot commercial building for approximately three weeks. Employees were exposed to temperatures up to 99 degrees Fahrenheit during this time. Employees were working in direct sunlight while wearing jeans and tool belts, carrying heavy equipment, lifting materials into place, and performing at a moderate to high level of exertion. Such exposures are likely to lead to the development of serious heat-related illnesses such as, but not limited to, heat cramps, heat stress, heat exhaustion, and heat stroke.
