OSH ACT of 1970 Section (5)(a)(1):The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that an employee was not protected from struck-by hazards while working in close proximity to earth moving equipment. (a) On June 16, 2024, an employee was working in the vicinity of a John Deere 544K AWD Loader when the operator was moving a Port-a-Potty in the bucket of the Loader with an obstructed view.

29 CFR 1926.651(k)(1): Daily inspections of excavations, the adjacent areas, and protective systems were not made by a competent person for evidence of a situation that could have resulted in possible cave-ins, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions. (a) On July 01, 2024, employees were working in an excavation approximately 5 feet deep, with nearly vertical walls, and Type C soil. Employees were splicing a new sewer line and taping the joint of a fiberoptic utility line along a high traffic roadway.
