29 CFR 1926.20(b)(2): The employer did not initiate and maintain programs which provided for frequent and regular inspections of the job site, materials and equipment to be made by a competent person(s): a) 4485 Kirkwood Hwy., Wilmington, DE 19808 (Kirkwood Plaza): On or about June 25, 2024, employees worked on site to conduct metal framing operations and were exposed to multiple hazards including but not limited to falls, when working from 15 feet in height above asphalt grade without fall protection or frequent and regular inspections made by a competent person to identify hazards.

29 CFR 1926.453(b)(2)(v): A body belt was not worn and/or a lanyard was not attached to the boom or basket when working from an aerial lift: Note: As of January 1, 1998, subpart M of this part (1926.502(d)) provides that body belts are not acceptable as part of a personal fall arrest system. The use of a body belt in a tethering system or in a restraint system is acceptable and is regulated: a) 4485 Kirkwood Hwy., Wilmington, DE 19808 (Kirkwood Plaza): On or about June 25, 2024, the employer did not ensure each employee operating a SkyJack model SJ45T, serial number #98002519 were using a fall protection device as required to operate the articulating boom.
