Ivan Carlos dba Ivan Carlos failed to certify to OSHA within 10 calendar days after the abatement date that each of the following cited violations had been corrected. 29 CFR  1926.100(a): Employees were not provided protective helmets while working in areas where there was a possible danger of head injury from impact, or from falling or flying objects, or from electrical shock and burns:  a) On July 2, 2024, employees working below employees performing roofing work exposed to struck-by hazards in that they were not wearing hard hats.  In accordance with 29 CFR 1903.19(c), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET).

29 CFR  1926.501(b)(13):  Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501(b):  The employer does not protect each employee from fall hazards while engaged in roofing work at elevations of up to approximately 18.1 feet above the ground by use of a guard rail system, safety net system, or personal fall arrest system.   a) On or about July 2, 2024, employees were exposed to the hazard of falling approximately between 9.9 and 18.1 feet while working without fall protection from a pitched roof.  No abatement certification or documentation required for this violation.

29 CFR  1926.1053(b)(1):  Portable ladders were used for access to an upper landing surface and the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface to which the ladder was used to gain access:   a) On July 2, 2024, ladders used by employees to gain access to the working surface did not have side rails capable of extended at least 3 feet above the surface.  Ivan Carlos dba Ivan Carlos was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.1053(b)(1), which was contained in OSHA inspection number 1671010, citation number 1, item number 3, and was affirmed as a final order on August 23, 2023, with respect to a workplace located at 1642 Timber Lane Dr., Montgomery, IL 60538.  Ivan Carlos dba Ivan Carlos was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.1053(b)(1), which was contained in OSHA inspection number 1479412, citation number 1, item number 2, and was affirmed as a final order on July 29, 2020, with respect to a workplace located at 3507 Red Wing Ln, Naperville, IL 60564.  No abatement certification or documentation is required for this item.
