29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with paragraph (b) or (c) of this section: a) On or about July 8, 2024, at 1048 Otter Creek Loop in Hazen, ND, employees in a trench over 20 feet in depth were replacing a sanitary sewer. Employees were not protected from cave in hazards while working in a trench where the protective system was not designed by a registered professional engineer, and did not have adequate shielding, shoring, or allowable configurations and sloping and benching, or any combination.

29 CFR 1926.651(g)(1)(i): Where oxygen deficiency (atmospheres containing less than 19.5 percent oxygen) or a hazardous atmosphere exists or could reasonably be expected to exist, the atmospheres in the excavation was not tested before employees entered excavations greater than 4 feet (1.22 m) in depth: a) On or about July 8, 2024, at 1048 Otter Creek Loop in Hazen, ND, employees were replacing a sanitary sewer in a trench with open sewage lines and an assessment was not performed to assure the work environment was free from respiratory hazards related to open sewage lines where liquid and solids were being introduced into the work area.
