OSH ACT of 1970 Section (5)(a)(1):The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that an employee who was working aloft from a ladder and tree, cutting tree limb(s) was not tied in or otherwise secured to the tree. Worksite: On or about July 8, 2024, the employer did not ensure that tree trimming operations were performed by a qualified person and that personal protective equipment was provided that would enable the employee to be tied into the tree during trimming. An employee who was not tied into the tree while cutting tree limbs from it was fatality injured after falling from the tree and or an extension ladder.
