29 CFR 1910.95(c)(1): The employer did not administer a continuing, effective hearing conservation program as described in 29 CFR 1910.9(c) through (o) whenever employee noise exposures equal or exceed an 8-hour time-weighted average sound level of 85 decibels measured on the A scale, or equivalently a dose of fifty percent: A) On or about July 9, 2024, in the water jet CNC room at Steel Art Company, Inc. on 189 Dean Street, Norwood, MA 02062, an employee was exposed to an 8-hour time weighted average noise level of 90.8 dBA (equivalently a dose of 112.6%) in excess of 85 dBA (equivalently a dose of 50%) while operating the water jet CNC machines where a hearing conservation program had not been implemented. B) On or about July 9, 2024, in the water jet CNC room at Steel Art Company, Inc. on 189 Dean Street, Norwood, MA 02062, an employee was exposed to an 8-hour time weighted average noise level of 89.7 dBA (equivalently a dose of 96.5%) in excess of 85 dBA (equivalently a dose of 50%) while operating the water jet CNC machines where a hearing conservation program had not been implemented. C) On or about July 9, 2024, in the water jet CNC room at Steel Art Company, Inc. on 189 Dean Street, Norwood, MA 02062, an employee was exposed to an 8-hour time weighted average noise level of 89.0 dBA (equivalently a dose of 87.4 %) in excess of 85 dBA (equivalently a dose of 50%) while operating the water jet CNC machines where a hearing conservation program had not been implemented. D) On or about July 9, 2024, in the belt sanding area at Steel Art Company, Inc. on 189 Dean Street, Norwood, MA 02062, an employee was exposed to an 8-hour time weighted average noise level of 89.8 dBA (equivalently a dose of 97.9%) in excess of 85 dBA (equivalently a dose of 50%) while operating belt sanding machine where a hearing conservation program had not been implemented. E) On or about July 9, 2024, in the belt sanding area at Steel Art Company, Inc. on 189 Dean Street, Norwood, MA 02062, an employee was exposed to an 8-hour time weighted average noise level of 87.6 dBA (equivalently a dose of 72.6%) in excess of 85 dBA (equivalently a dose of 50%) while operating the belt sanding machine where a hearing conservation program had not been implemented. The hearing conservation program shall include monitoring, baseline & annual audiometric testing, noise training, and posting of standard 29 CFR 1910.95.
