29 CFR 1910.134(e)(1): The employer did not provide a medical evaluation to determine the employee's ability to use a respirator, before the employee was fit tested or required to use the respirator in the workplace: (a) On July 5, 2024, at Railroad Milepost 343.5, Carrington Sub near Bordulac, North Dakota, an employee was exposed to respiratory distress when instructed to wear a SCBA (Self Contained Breathing Apparatus) during the process of disconnecting train cars at a derailment site. The employee was not medically evaluated for the use of an SCBA.
