The employer shall provide training to ensure that the purpose and function of the energy control program are understood by employees and that the knowledge and skills required for the safe application, usage, and removal of the energy controls are acquired by employees. The training shall include the following:  (A) Each authorized employee shall receive training in the recognition of applicable hazardous energy sources, the type and magnitude of the energy available in the workplace, and the methods and means necessary for energy isolation and control.  a) On or about July 3, 2024, Monti, Inc. did not train press operators as authorized employees to recognize hazardous energy sources, and the methods and means necessary for energy isolation and control prior to an employee clearing jams in the point of operation of the Minster 400 ton part revolution press.  b) On and after July 9, 2024 Monti, Inc. did not train press operators as authorized employees to recognize hazardous energy sources, and the methods and means necessary for energy isolation and control prior to employees performing servicing and maintenance tasks to include but not limited to cleaning and die changes for the SEYI SAG-440, Stamtec GTX-300, Stamtec G1-80 part revolution presses in the Stamping Department.

29 CFR 1910.147(d): Application of control. The established procedures for the application of energy control (the lockout or tagout procedures) shall cover the following elements and actions and shall be done in the following sequence:  (d)(1) Preparation for shutdown. Before an authorized or affected employee turns off a machine or equipment, the authorized employee shall have knowledge of the type and magnitude of the energy, the hazards of the energy to be controlled, and the method or means to control the energy.  (d)(2) Machine or equipment shutdown. The machine or equipment shall be turned off or shut down using the procedures established for the machine or equipment. An orderly shutdown must be utilized to avoid any additional or increased hazard(s) to employees as a result of the equipment stoppage.  (d)(3) Machine or equipment isolation. All energy isolating devices that are needed to control the energy to the machine or equipment shall be physically located and operated in such a manner as to isolate the machine or equipment from the energy source(s).  (d)(4) Lockout or tagout device application. Lockout or tagout devices shall be affixed to each energy isolating device by authorized employees.  (d)(5) Stored energy. Following the application of lockout or tagout devices to energy isolating devices, all potentially hazardous stored or residual energy shall be relieved, disconnected, restrained, and otherwise rendered safe.  (d)(6) Verification of isolation. Prior to starting work on machines or equipment that have been locked out or tagged out, the authorized employee shall verify that isolation and deenergization of the machine or equipment have been accomplished.  a) On or about July 3, 2024, Monti, Inc. did not ensure press operators followed elements d1-d6 prior to reaching into the point of operation for troubleshooting jams while being exposed to pinch points of the Minster 400 ton part revolution press.  b) On and after July 9, 2024, Monti, Inc. did not ensure press operators followed elements d1-d6 prior to performing servicing and maintenance tasks to include but not limited to cleaning  bolsters and performing die changes of the SEYI SAG-440, Stamtec GTX-300, and Stamtec G1-80 part revolution presses.

(iii) A means of selecting Off, "Inch," Single Stroke, and Continuous (when the continuous function is furnished) shall be supplied with the clutch/brake control to select type of operation of the press. Fixing of selection shall be by means capable of supervision by the employer.  a) On and before July 3, 2024, the fixing of selection of off, "inch," single stroke, and continuous was not under the supervision of the employer in that the Minster 400 ton part revolution press selector switch was left on inch mode for production operation, and operators were authorized to switch modes as needed.  b) On and before July 9, 2024, the fixing of selection of off, "inch," single stroke, and continuous was not under the supervision of the employer in that the Seyi SAG-440 ton part revolution press selector switch was left on inch mode for production operation, and operators were authorized to switch modes as needed.  c) On and before July 9, 2024, the fixing of selection of off, "inch," single stroke, and continuous was not under the supervision of the employer in that the Stamtec 330 ton part revolution press selector switch was left on inch mode for production operation, and operators were authorized to switch modes as needed.  d) On and before July 9, 2024, the fixing of selection of off, "inch," single stroke, and continuous was not under the supervision of the employer in that the Stamtec G1-80 ton part revolution press selector switch was left on inch mode for production operation, and operators were authorized to switch modes as needed.

29 CFR 1910.217(b)(7)(v): Machines using part revolution clutches. Two-hand controls for single stroke shall conform to the following requirements:  (c) The control system shall incorporate an anti-repeat feature. (d) The control systems shall be designed to require release of all operators' hand controls before an interrupted stroke can be resumed. This requirement pertains only to those single-stroke, two-hand controls manufactured and installed on or after August 31, 1971.  a) On or about July 9, 2024, Monti, Inc. did not ensure the control system of the Stamtec G1-80 was designed to require release of all operators' hand controls before an interrupted stroke can be resumed in that the employee held down the 2 hand controls and the machine continued to cycle without stopping.

29 CFR 1910.217(c)(2)(i)(a): Safeguarding the point of operation -  Point of operation guards. Every point of operation guard shall meet the following design, construction, application, and adjustment requirements:  (a) It shall prevent entry of hands or fingers into the point of operation by reaching through, over, under or around the guard;    a) On July 3, 2024, the employer did not guard the feeder section on the Minster 400 ton part revolution press, the feeder's was not guarded in that operators were able to reach through to the point of operation for the Minster using manual mode and a pendant with one hand while reaching through the Minster's point of operation to the feeder  with the other hand creating a caught in hazard caused by the material from the feeder.   b) On July 9, 2024, the employer did not adequately utilize "point of operation guards" on the Stamtec G2-250 part revolution press's point of operation was not adequately guarded on the rear of the press in that the light curtains were positioned approximately 43" deep and had approximately 99" wide of undetected space. to where employees can stand near the point of operation and not be detected    b) On July 9, 2024, the employer did not adequately utilize "point of operation guards" on the Stamtec GTX-300 part revolution press's point of operation was not adequately guarded on the rear of the press in that the light curtains were positioned approximately 21" deep and had approximately 48" high of undetected space where employees can stand near the point of operation and not be detected.

29 CFR 1910.217(e)(1):Inspection, maintenance, and modification of presses - Inspection and maintenance records. The employer shall establish and follow an inspection program having a general component and a directed component.  (e)(1)(i) Under the general component of the inspection program, the employer shall:  (A) Conduct periodic and regular inspections of each power press to ensure that all of its parts, auxiliary equipment, and safeguards, including the clutch/brake mechanism, anti-repeat feature, and single-stroke mechanism, are in a safe operating condition and adjustment;  (B) Perform and complete necessary maintenance or repair, or both, before operating the press; and  (C) Maintain a certification record of each inspection, and each maintenance and repair task performed, under the general component of the inspection program that includes the date of the inspection, maintenance, or repair work, the signature of the person who performed the inspection, maintenance, or repair work, and the serial number, or other identifier, of the power press inspected, maintained, and repaired.  a) On or about July 9, 2024, the employer did not perform adequate inspections of Mechanical Power Presses such as but not limited to; the Minster 400, Stamtec G2-250, Stamtec GTX-300 to ensure that periodic and regular inspections of each power press included it parts such as the mode operated in, auxiliary equipment such as the feeder, and safeguards such as the removing the key from the selector switch, ensuring the presses were not operated in inch mode, ensuring the feeder was part of the point of operation guarding for the Minster 400, making sure that all maintenance or repairs were done such as correcting the location of the light curtains on the back of the presses to ensure that employees could not reach into the back of the press and maintaining a certification record for each inspection and maintenance and repair conducted on each mechanical power press  to prevent exposure to hazards such as but not limited to pinch point hazards due to machine guards not present for the point of operation of the feeder of the Minster 400, undetected spaces around the presses of the Stamtec G2-250 and Stamtec GTX-300, and bypassed anti-repeating features of the Stamtec G1-80.

The employer shall train and instruct the operator in the safe method of work before starting work on any operation covered by this section. The employer shall insure by adequate supervision that correct operating procedures are being followed.  a) On or about July 3, 2024, the operator of the Minster 400 part revolution mechanical power press were not trained in the operation of the press such as but not limited to safe methods to troubleshoot feeder jams  understanding how the different mode of inch, single stroke and continuous work, how the safety features such as point of operation guarding, anti-repeat features worked, and how to conduct a weekly inspection.  b) On or about July 9, 2024, the operators of the Stamtec G1-80 part revolution mechanical power press were not trained in the operation of the press such as but not limited to; understanding how the different mode of inch, single stroke and continuous worked, how the safety features such as point of operation guarding, anti-repeat features worked, and how to conduct a weekly inspection.

The employer shall, within 30 days of the occurrence, report to either the Director of the Directorate of Safety Standards Programs, OSHA, U.S. Department of Labor, Washington, D.C. 20210, or the State agency administering a plan approved by the Assistant Secretary of Labor for Occupational Safety and Health, all point of operation injuries to operators or other employees.  a) On or about July 3, 2024, the employer did not report a point of operation injury that occurred to an operator on the Minster mechanical power press to the Director of the Directorate of Safety Standards Programs, OSHA.
