29 CFR 1910.134(c)(2)(i): Respirator users were not provided with the information contained in Appendix D to 29 CFR 1910.134 when the employer determined that any voluntary respirator use was permissible:  a.) J & E Automotive, LLC dba Interstate Nissan - On or about, 7/11/24, and at times prior thereto, an N95 disposable respirator was being worn voluntarily by employees.  The employees had not been provided in Appendix D of the OSHA Respiratory standard prior to using the respirator.  b.) J & E Automotive, LLC dba Interstate Nissan - On or about, 7/11/24, and at times prior thereto, an N95 half mask respirator with cartridges was being worn voluntarily by employees.  The employees had not been provided with Appendix D of the OSHA Respiratory standard prior to using the respirator.  ABATEMENT CERTIFICATION REQUIRED: Abatement certification is required within 10 days after the abatement date noted on the citation (see below).  This certification shall include a statement that abatement is complete, the date abatement was completed, method of abatement, and state that employees and their representatives were informed of this abatement.

29 CFR 1910.134(c)(2)(ii): The employer did not establish and implement those elements of a written program necessary to ensure that any employee using a respirator voluntarily was medically able to use that respirator, and that the respirator was cleaned, stored, and maintained so that its use does not present a health hazard to the user:  a.) J & E Automotive LLC dba Interstate Nissan; 8931 Peach Street, Erie, PA detail area - On or about 7/11/24, and at times prior thereto, an employee wore a half mask air-purifying respirator (3M brand with P100 cartridges) during detailing operations on vehicles.  The employer did not establish the required elements of a respiratory protection program.
