29 CFR 1910.1200 (e)(1): The employer did not develop, implement and maintain at the workplace, a written hazard communication program which at least describes how the criteria specified in paragraphs (f), (g) and (h) of this section for labels and other forms of warning, material safety data sheets, and employee information and training will be met: a) On or about July 11, 2024 - Rainbow Plastics, Inc. located at 371 Vandervoort St, Brooklyn. NY 11211 Employees use hazardous chemicals such as but not limited to Blend 80% NP ALC /20% NP ACET that contains 80% 1-propanol and 20% acetic acid propyl ester , PI II PMS 485C Red, Polytech G RR SP2945 Blue, PK II High gloss Black RE-1, Polytech G RR PMS 123C Yellow, Polytech G PMS 266 C Purple, United Brothers Green that contains 1- propanol (25-50%), acetic acid propyl ester (10%), 2 propanol, 1-propoxy (5%)and naphtha (petroleum) (3%) in the preparation of ink solutions. The employer did not maintain a written hazard communication program. NOTE: BECAUSE ABATEMENT OF THIS VIOLATION IS ALREADY DOCUMENTED IN THE CASEFILE, THE EMPLOYER NEED NOT SUBMIT CERTIFICATION NOR DOCUMENTATION OF ABATEMENT OF THIS VIOLATION AS NORMALLY REQUIRED BY 29 CFR 1903.19.

NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM, FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1,000 AS PER 29 CFR 1903.19
