29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652 (b) or (c). a) On or about July 11, 2024 at the address of 104 Franklin St. Archbold, OH 43502. The employer Salenbien Trucking and Excavating, Inc. failed to ensure employees were adequately protected from cave-in hazards. Employees installing 8" PVC main waterline in an open trench approximately 9 feet deep were exposed to cave-in hazards from unshielded soil.

29 CFR 1926.652(g)(2): Excavations of earth material to a level no greater than 2 feet (.61m) below the bottom of a shield was permitted: a) On or about July 11, 2024 at the address of 104 Franklin St. Archbold, OH 43502: The employer Salenbien Trucking and Excavating, Inc. failed to ensure the bottom of the protective trench shield was within 2ft from the base of the excavation. Employees were exposed to potential wall failure when the bottom of the protective shield was 30 inches above the bottom of the excavation during the installation of an 8-inch water main line
