OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of entrapment between the forklift and the ground:  (a) 5353 Bernville Road, Bernville, Pennsylvania - An employee operated the Clark C25 sit-down rider forklift to pick up and move slabs and remnants of granite and other stone.  The forklift had an operator protection device (which included a seatbelt), but the employee did not use the seatbelt at all times while operating the forklift, exposing the employee to the hazard of entrapment between the forklift and the ground in the event of a forklift tip over, on or about July 11, 2024.  Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and shall state that employees and their representatives were informed of this abatement.

29 CFR 1910.145(c)(3): Safety instruction signs were not used where there was a need for general instructions and suggestions relative to safety measures:  (a) Indoor Showroom and Outside Slab and Remnant Storage Area - The metal A-frames used for storing slabs and remnants of granite and other stones did not have any safety signs posted instructing employees on the permissible load capacity of each A-frame, exposing employees to a struck-by hazard from overloading, on or about July 11, 2024.  (b) Indoor Showroom and Outside Slab and Remnant Storage Area - The areas for storing slabs and remnants of granite and other stones did not have safety signs posted instructing employees not to walk or stand in a slab's or remnant's fall shadow (the area on both sides of a slab or remnant where the slab or remnant could land or topple if it fell), exposing employees to a struck-by hazard, on or about March 23, 2024.  Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and shall state that employees and their representatives were informed of this abatement.

29 CFR 1910.178(a)(4): Modifications and additions which affect capacity and safe operation of powered industrial truck were performed by the employer without the manufacturer's prior written approval:   (a) 5353 Bernville Road, Bernville, Pennsylvania - Employees used a boom attachment and slab clamp on the forks of the Clark C25 sit-down rider forklift to lift and move slabs of granite and other stone.  The employer did not get the forklift manufacturer's prior written approval to use this attachment, exposing employees to hazards such as overloading and instability, on or about, July 11, 2024.  Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and shall state that employees and their representatives were informed of this abatement.

29 CFR 1910.178(l)(2)(ii): The employer did not ensure that each operator had successfully completed the training consisting of a combination of formal instruction (e.g., lecture, discussion, interactive computer learning, video tape, written material), practical training (demonstrations performed by the trainer and practical exercises performed by the trainee), and evaluation of the operator's performance in the workplace:  (a) 5353 Bernville Road, Bernville, Pennsylvania - The employer did not provide formal powered industrial truck training nor operator evaluation, as required by the standard, to employees, and the employer permitted these employees to operate the Clark C25 sit-down rider forklift, exposing employees to hazards including, but not limited to, entrapment between the forklift and the ground in the event of a forklift tip over, on or about  July 11, 2024.  Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and shall state that employees and their representatives were informed of this abatement.

29 CFR 1904.4(a): The employer did not record each work-related fatality, injury or illness case that resulted in the general recording criteria on the OSHA Form 300 or equivalent:  (a) 5353 Bernville Road, Bernville, Pennsylvania - On or about March 23, 2024, the employer did not record the following workplace injury on the OSHA Form 300 or equivalent for calendar year 2024:  A stone remnant fell and struck an employee's leg resulting in seven fractures to the leg and days away from work.  Abatement certification required within 10 days after abatement date.  The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.

29 CFR 1904.39(a)(2): The employer did not report within 24-hours a work-related incident resulting in in-patient hospitalization, amputation, or the loss of an eye:  (a) 5353 Bernville Road, Bernville, Pennsylvania - An employee suffered work-related fractures to the leg on March 23, 2024 after getting struck-by a falling remnant of stone.  The injury required in-patient hospitalization, and the employer did not report this hospitalization to OSHA.  No abatement certification or documentation required
