Employees shall always stand firmly on the floor of the basket and shall not sit or climb on the edge of the basket or use planks, ladders, or other devices for a work position.  On or about July 11, 2024, at 419 Donald Driver Way in Green Bay, Wisconsin, an employee was exposed to a fall hazard working from a telescopic boom lift 26 feet above surface level at the basket's access point with the gate open, with one foot on the gate's mid-rail and one foot on top of the toe guard.

29 CFR  1926.453(b)(2)(v):  Aerial lifts.  Extensible and articulating boom platforms.  A body belt shall be worn and a lanyard attached to the boom or basket when working from an aerial lift.   Note to paragraph (b)(2)(v):  As of January 1, 1998, subpart M of this part (1926.502(d)) provides that body belts are not acceptable as part of a personal fall arrest system. The use of a body belt in a tethering system or in a restraint system is acceptable and is regulated under 1926.502(e).  On or about July 11, 2024, at 419 Donald Driver Way in Green Bay, Wisconsin, an employee was exposed to a fall hazard working from a telescopic boom lift 26 feet above surface level without using required personal fall protection equipment.

29 CFR  1926.502(d)(16)(iii):  Personal fall arrest systems when stopping a fall shall be rigged such that an employee can neither free fall more than 6 feet (1.8 m), nor contact any lower level.  a)  On or about July 11, 2024, at 419 Donald Driver Way in Green Bay, Wisconsin, an employee was exposed to potential hazards from free fall of more than 6 feet while working from a telescopic boom lift without following manufacturer's recommendations in the installation and use of personal fall protection equipment.  Body harness was connected to a 6-foot lanyard, the 6-foot lanyard was connected to a 6-foot self-retracting device, and the self-retracting device was connected to work platform's anchor point.  b)  On or about July 11, 2024, at 419 Donald Driver Way in Green Bay, Wisconsin, employees were exposed to potential hazards from free fall of more than 6 feet while working from outside a telescopic boom lift without following manufacturer's recommendations in the installation and use of personal fall protection equipment.  Body harnesses were connected to 6-foot lanyards, the 6-foot lanyards were connected to 6-foot self-retracting devices, and the self-retracting devices were connected to work platform's anchor points.

Snap-hooks shall be sized to be compatible with the member to which they are connected to prevent unintentional disengagement of the snap-hook by depression of the snap-hook keeper by the connected member or shall be a locking-type snap-hook designed and used to prevent disengagement of the snap-hook by the contact of the snap-hook keeper by the connected member.  a)  On or about July 11, 2024, at 419 Donald Driver Way in Green Bay, Wisconsin, an employee was exposed to potential fall hazards working from a telescopic boom lift 26 feet above surface level without following manufacturer's recommendations in the installation and use of personal fall protection equipment.  A lanyard snap-hook was connected to a self-retracting device snap-hook which connected the body harness to the basket's anchor point.  b)  On or about July 11, 2024, at 419 Donald Driver Way in Green Bay, Wisconsin, employees were exposed to potential fall hazards working from outside a telescopic boom lift 35 feet above surface level without following manufacturer's recommendations in the installation and use of personal fall protection equipment.  Two lanyard snap-hooks each were connected to a self-retracting device snap-hook which connected the body harnesses to the basket's anchor points.

The employer shall have each employee who performs work while on a scaffold trained by a person qualified in the subject matter to recognize the hazards associated with the type of scaffold being used and to understand the procedures to control or minimize those hazards. The training shall include the nature of any electrical hazards, fall hazards, and falling object hazards in the work area.  On or about July 11, 2024, at 419 Donald Driver Way in Green Bay, Wisconsin, the employer did not provide required boom lift safety training for employees working from a JLG telescopic boom lift.  Employees were working from the basket with the access gate open, operating basket with access gate open, and crawling between top and mid guardrails to access/egress the basket.

29 CFR  1926.503(a)(1):  Fall Protection.  Training Requirements.  The employer shall provide a training program for each employee who might be exposed to fall hazards. The program shall enable each employee to recognize the hazards of falling and shall train each employee in the procedures to be followed in order to minimize these hazards.   On or about July 11, 2024, at 419 Donald Driver Way in Green Bay, Wisconsin, the employer did not provide required fall protection safety training for employees working at heights greater than six feet.  Employees were preparing the exterior walls on a five-story building for paint from a boom lift basket without installing personal fall protection equipment following manufacturer's recommendations and without using required personal fall protection equipment.
