29 CFR 1926.651(j)(2): Employees were not protected from excavated or other materials or equipment that could pose a hazard by falling or rolling into excavations. Protection shall be provided by placing and keeping such materials or equipment at least 2 feet (.61 m) from the edge of excavations, or by the use of retaining devices that are sufficient to prevent materials or equipment from falling or rolling into excavations, or by a combination of both if necessary. a) On or about 7/11/2024, in the east excavation at 30 Main Street, Parshall, North Dakota employees were setting rebar and concrete forms to build support columns for a new commercial business. Employees were exposed to loose rock on the side and edge of the excavation that posed a risk of falling onto employees in the excavation. b) On or about 7/11/2024, in the middle excavation at 30 Main Street Parshall, North Dakota, employees were setting rebar and concrete forms to build support columns for a new commercial business. Employees were exposed to loose rock and metal on the side and edge of the excavation and a seven-foot-tall spoil pile against the edge of the excavation that posed a risk of falling onto employees in the excavation. c) On or about 7/11/2024, in the west excavation, at 30 Main Street, Parshall, North Dakota, employees were setting rebar and concrete forms to build support columns for a new commercial business. Employees were exposed to loose rock on the side and edge of the excavation and a seven-foot-tall spoil pile against the edge of the excavation that posed a risk of falling onto employees in the excavation.

29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with paragraph (b) or (c) of this section: a) On or about 7/11/2024, in the east excavation, located at 30 Main Street, Parshall, North Dakota, employees were setting rebar and concrete forms to build support columns for a new commercial business. Employees were exposed to the potential for vertical walls over six feet high collapsing onto employees in the excavation. b) On or about 7/11/2024, in the middle excavation, located at 30 Main Street, Parshall, North Dakota. Employees were setting rebar and setting concrete forms to build support columns for a new commercial business. Employees were exposed to the potential for vertical walls over six feet high collapsing onto employees in the excavation. c) On or about 7/11/2024, in the west excavation, located at 30 Main Street, Parshall, North Dakota. Employees were setting rebar and setting concrete forms to build support columns for a new commercial business.
