29 CFR 1910.1200(e)(1):The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met: (Construction Reference: 1926.59) At the job site located at 8647 Melrose, Overland Park, KS 66212, employees engaged in roofing activities were exposed to chemical hazards in that a written hazard communication program had not been developed, implemented and maintained at the jobsite. Employees were handling asphalt shingles and gasoline. The chemical hazards associated with asphalt shingles and gasoline are skin and eye irritation, and may cause drowsiness, dizziness and upper respiratory irritation. Additionally, gasoline, can act as a fueling agent due to its extreme flammability as a liquid and vapor.

29 CFR 1910.1200(g)(1): Employers did not have a safety data sheet in the workplace for each hazardous chemical which they use: (Construction Reference: 1926.59) At the job site located at 8647 Melrose, Overland Park, KS 66212, employees engaged in roofing activities were exposed to chemical hazards in that they were not provided access to the Safety Data Sheet (SDS) for asphalt shingles and gasoline at the jobsite. The chemical hazards associated with asphalt shingles and gasoline are skin and eye irritation, and may cause drowsiness, dizziness and upper respiratory irritation. Additionally, gasoline, can act as a fueling agent due to its extreme flammability as a liquid and vapor.
