29 CFR 1926.651(k)(1): Daily inspections of excavations, the adjacent areas, and protective systems were not made by a competent person for evidence of a situation that could have resulted in possible cave-ins, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions: a)13900 Birmingham Hwy, Milton GA: On or about June 18, 2024, and times prior, the employer exposed employees to cave-in hazards, in that the employer did not ensure that an inspection of the trench was conducted by a competent person after digging had been performed with an excavator during demolition of median to install a catch basin.

29 CFR 1926.652(a)(1): Each employee in an excavation shall be protected from cave-ins by an adequate protective system designed in accordance with paragraph (b) or (c) of this section except when: Excavations are made entirely in stable rock; or Excavations are less than 5 feet (1.52 m) in depth and examination of the ground by a competent person provides no indication of a potential cave-in. a) 13900 Birmingham Hwy, Milton GA: On or about June 18, 2024, and times prior, the employer exposed employees to cave-in hazards, in that employees were in a trench, with dimensions of 8 feet wide by 9 feet length by 5 feet deep. The employer failed to provide cave in protection for employees replace a catch basin in the center lane of a two-lane road.
