29 CFR  1910.1200(e)(1):The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met:  At the jobsite located at 22413 W. 52nd Terrace in Shawnee, Kansas, the employer failed to develop a written hazard communication program to describe how the program would be implemented to include proper training, labeling, and the administration of safety data sheets, to address their chemicals such as the hazards of gasoline, which is an irritant and can cause dermal allergic reactions and eye damage.

29 CFR  1910.1200(h)(1):Employees were not provided effective information and training on hazardous chemicals in their work area at the time of their initial assignment and whenever a new hazard that the employees had not been previously trained about was introduced into their work area: (Construction Reference: 1926.59)  At the jobsite located at 22413 W. 52nd Terrace in Shawnee, Kansas, employee(s) had not been provided effective information and training to recognize, evaluate, and control exposure to hazardous chemicals including but not limited to gasoline, which is an irritant and can cause dermal allergic reactions if contact with skin is made, and an eye damage hazard if contact with eyes is made while handling the chemical.

29 CFR  1910.1200(g)(8):  The employer did not maintain in the workplace copies of the required safety data sheets for each hazardous chemical, and did not ensure that they were readily accessible during each work  shift to employees when they were in their work area(s).  At the jobsite located at 22413 W. 52nd Terrace in Shawnee, Kansas, the employer did not maintain safety data sheets for hazardous chemicals used onsite, including but not limited to, gasoline, which is an irritant and can cause dermal allergic reactions and eye damage.
