Whenever any sling is used, the following practices shall be observed: (4): Slings shall not be loaded in excess of their rated capacities.  a) On 7/10/2024 the employer did not ensure that employees utilizing an alloy steel chain sling (rated at 7100 lbs.) was not overloaded in that a Caterpillar forklift (weighing 11120 lbs.) was stuck in the mud.  Employees  attempted to pull the forklift out of the mud with a Bobcat (weighing 6395 lbs.).  Employees were exposed to a struck-by hazard due to overloading the chain sling.

1910.184(c) Safe operating practices. Whenever any sling is used, the following practices shall be observed: (10):Hands or fingers shall not be placed between the sling and its load while the sling is being tightened around the load.  a) On 7/10/2024 the employer did not ensure that employees working around a alloy steel chain sling kept their hands or fingers off of the sling as it was being tightened.  As a result, employees were exposed to a caught-in hazard while attempting to pull a Caterpillar forklift from out of the mud in the yard.

Alloy steel chain slings shall have permanently affixed durable identification stating size, grade, rated capacity, and reach.  a)  On or about 7/10/2024 the employer did not ensure that employees pulling a forklift from the mud, with a bobcat utilizing an alloy chain sling, was able to identify the rating and capacity of the chain sling, due to the alloy chain sling's tag not being legible to ensure that it was capable of withstanding the weight of the 11000 pound forklift it was supposed to pull out of the mud.

29 CFR  1910.184(e)(3)(iii): The thorough inspection of alloy steel chain slings shall be performed by a competent person designated by the employer, and shall include a thorough inspection for wear, defective welds, deformation and increase in length. Where such defects or deterioration are present, the sling shall be immediately removed from service.   a) On 7/10/2024, the employer did not ensure that a thorough inspection was completed by a competent person on the alloy steel chain sling prior to utilizing them to pull a forklift from the mud, that would have revealed that the id tag was unreadable and should have been removed from service.
