OSH ACT of 1970 Section (5)(a)(1):  The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were not protected from the hazard of high heat while performing job duties:  a)  On or about July 16, 2024, employees were exposed to the hazard of high heat from working outside under direct sunlight during the performance of their job duties, including the picking and packing of watermelons over a period of 8 hours. Employees performing hard manual labor were exposed to temperatures of approximately 93�F (33.9 �C) with relative humidity levels of 56 - 77%. The calculated Wet Bulb Globe Temperatures (WBGT) between 7:30 AM and 4:00 PM was 87�F (31�C) in direct sunlight and 83�F (28�C) in shade with a Heat Index up to 102�F (39�C). Such exposures are likely to lead to the development of serious heat-related illnesses such as, but not limited to, heat cramps, heat stress, heat exhaustion, and heat stroke. The above conditions resulted in a work-related death of one employee that occurred at approximately 6:00 PM.  b)  On or about July 17, 2024, employees were exposed to the hazard of high heat from working outside under direct sunlight during the performance of their job duties, including the picking and packing of watermelons over a period of 8 hours. Employees performing hard manual labor were exposed to temperatures of approximately 83�F (28.3 �C) with relative humidity levels of 61- 85%. The calculated Wet Bulb Glove Temperatures (WBGT) between 7:30 AM and 4:00 PM was 80�F (27�C) in direct sunlight and 77�F (25�C) in shade with a Heat Index up to 75�F (24�C). Such exposures are likely to lead to the development of serious heat-related illnesses such as, but not limited to, heat cramps, heat stress, heat exhaustion, and heat stroke.
