29 CFR 1926.1153(c)(2)(ii): For tasks performed using wet methods, apply water at flow rates sufficient to minimize release of visible dust. On or about July 17, 2024, at the worksite located at 1016 North Broadway, De Pere, Wisconsin; the employer did not ensure that the integrated water delivery system on a walk-behind saw (Manufacturer: Husqvarna, Type: FS400LV, Product Number: 965148208, Serial Number: 2016 4900009) operated by an employee to cut concrete had provided water at flow rates sufficient to minimize release of visible dust, exposing an employee to the hazards associated with respirable crystalline silica. The walk-behind saw (Manufacturer: Husqvarna, Type: FS400LV, Product Number: 965148208, Serial Number: 2016 4900009) generated a visible dust cloud when used with the water tank and integrated water delivery system.

29 CFR 1926.1153(g)(1)(i): The employer shall establish and implement a written exposure control plan that contains various elements, including a description of the tasks in the workplace that involve exposure to respirable crystalline silica. On or about July 17, 2024, at the worksite located at 1016 North Broadway, De Pere, Wisconsin; the employer did not ensure that cutting concrete with a walk-behind saw, a task in the workplace that involves exposure to respirable crystalline silica, was included in the written exposure control plan, exposing an employee to the hazards associated with respirable crystalline silica. An employee was observed cutting concrete with a walk-behind saw (Manufacturer: Husqvarna, Type: FS400LV, Product Number: 965148208, Serial Number: 2016 4900009).
