29 CFR 1910.1200(e)(1): The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met:  a) Assembly Area - On or about July 18, 2024, the employer did not develop a written hazard communication program for employees exposed to chemicals such as, but not limited to, those found in DE1618: methyl acetate, propane, butane, isubutyl acetate, toluene, 2-methoxy-1-methylethyl acetate, titanium dioxide, methyl ethyl ketoxime, and xylene, mixed isomers.  b) Spray Area - On or about July 18, 2024, the employer did not develop a written hazard communication program for employees exposed to chemicals such as, but not limited to, those found in Brown Aluminum Oxide, various grades: aluminum oxide and titanium dioxide.   Abatement Certification Required.

29 CFR 1910.1200(e)(1)(i): The employer did not compile a list of the hazardous chemicals known to be present using a product identifier that was referenced on the appropriate safety data sheet:   a) Assembly Area - On or about July 18, 2024, the employer did not compile a list of hazardous chemicals known to be present at the site for employees exposed to chemicals such as, but not limited to, those found in DE1618: methyl acetate, propane, butane, isubutyl acetate, toluene, 2-methoxy-1-methylethyl acetate, titanium dioxide, methyl ethyl ketoxime, and xylene, mixed isomers.  b) Spray Area - On or about July 18, 2024, the employer did not compile a list of hazardous chemicals known to be present at the site for employees exposed to chemicals such as, but not limited to, those found in Brown Aluminum Oxide, various grades: aluminum oxide and titanium dioxide. 29 CFR 1910.134(e)(1): The employer did not provide a medical evaluation to determine the employee's ability to use a respirator, before the employee was fit tested or required to use the respirator in the workplace:  a) Assembly Area - On or about July 18, 2024, employees were required to wear tight fitting respiratory protection equipment while handling hazardous chemicals including, but not limited to, those found in DE1618: methyl acetate, propane, butane, isubutyl acetate, toluene, 2-methoxy-1-methylethyl acetate, titanium dioxide, methyl ethyl ketoxime, and xylene, mixed isomers and were not medically evaluated to ensure they could safely wear the respirator.  b) Spray Area - On or about July 18, 2024, employees were required to wear tight fitting respiratory protection equipment while handling hazardous chemicals including, but not limited to, those found in Brown Aluminum Oxide, various grades: aluminum oxide and titanium dioxide and were not medically evaluated to ensure they could safely wear the respirator. 29 CFR 1910.134(f)(1): The employer did not ensure that employee(s) required to use a tight-fitting facepiece respirator passed the appropriate qualitative fit test (QLFT) or quantitative fit test (QNFT):  a) Assembly Area - On or about July 18, 2024, employees were required to wear tight fitting respiratory protection equipment while handling hazardous chemicals including, but not limited to, those found in DE1618: methyl acetate, propane, butane, isubutyl acetate, toluene, 2-methoxy-1-methylethyl acetate, titanium dioxide, methyl ethyl ketoxime, and xylene, mixed isomers and were not fit tested prior to wearing the respiratory protection equipment.   b) Spray Area - On or about July 18, 2024, employees were required to wear tight fitting respiratory protection equipment while handling hazardous chemicals including, but not limited to, those found in Brown Aluminum Oxide, various grades: aluminum oxide and titanium dioxide and were not fit tested prior to wearing the respiratory protection equipment.
