29 CFR 1926.501(b)(13):Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):  a) Timber Banks, Tall Tree Lane, Lot 327, Baldwinsville, NY 13027, on the roof, on or about 7/8/24: Employees installing roofing material without fall protection onto a two-story residential building, with a 10:12 pitch on the main roof and a 12:12 pitch on the gable sections, were exposed to fall hazards of 13 feet.

29 CFR 1926.502(e)(2): Positioning devices were not secured to an anchorage capable of supporting at least twice the potential impact load of an employee's fall or 3,000 pounds (13.3 kN), whichever was greater:  a) Timber Banks, Tall Tree Lane, Lot 327, Baldwinsville, NY 13027, on the roof, on or about 7/8/24: Employees used positioning systems to install roofing on a two-story residential building, with a 10:12 and 12:12 pitch roof, where the anchorage could not support at least twice the potential impact load in a fall or 3,000 lbs. Employees were exposed to a fall of 13 feet .

9 CFR 1926.503(a)(1): The employer did not provide a training program for each employee potentially exposed to fall hazards to enable each employee to recognize the hazards of falling and the procedures to be followed in order to minimize these hazards:  a) Timber Banks, Tall Tree Lane, Lot 327, Baldwinsville, NY 13027, on the roof, on or about 7/8/24: Employees were not trained to recognize fall hazards and the procedures to follow to minimize fall hazards, when multiple errors were identified with the application of personal fall arrest systems and positioning systems on site.  Abatement certification must be submitted for this item.

29 CFR 1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed:  a) Timber Banks, Tall Tree Lane, Lot 327, Baldwinsville, NY 13027, accessing the roof, on or about 7/8/24: Employees were using an articulating aluminum ladder to access and egress the roof where that ladder did not extend at least 3 feet above the upper landing.
