OSH ACT of 1970 Section (5)(a)(1): Section 5(a)(1) of the Occupational Safety and Health Act: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were not protected from the hazard of high heat while performing job duties. On or about July 17, 2024, and at times prior, employees were exposed to the hazard of high heat from the kitchen ovens and heat racks during the performance of their job duties, including preparations of various foods. The calculated Wet Bulb Globe Temperature (WBGT) was between 81.68 F and 91.76 F. Such exposures are likely to lead to the development of serious heat-related illnesses such as, but not limited to, heat cramps, heat stress, heat exhaustion, and heat stroke. Employees have reported heat-related signs and symptoms such as heat rash, dehydration, shortness of breath, and excessive sweating.
