29 CFR 1926.651(c)(2):A stairway, ladder, ramp or other safe means of egress was not located in trench excavations that were 4 feet (1.22m) or more in depth so as to require no more than 25 feet (7.62m) of lateral travel for employees. LOCATION: The jobsite at 24 Westminster Ave. Roxbury, MA a) A closed orange A-frame ladder within the right side of excavation being used for egress. b) An extension ladder near the back right side of the excavation not extended 3 feet above the upper landing surface, and leaning against spill pile, being used for egress. On or about July 20, 2024, employees were exposed to struck-by and fall hazards while working within an excavation an estimated 9 feet deep, where the employer did not ensure that a stairway, ladder, ramp or other safe means of egress was located in the excavation.

29 CFR 1926.651(j)(2): Employees shall be protected from excavated or other materials or equipment that could pose a hazard by falling or rolling into excavations. Protection shall be provided by placing and keeping such materials or equipment at least 2 feet (.61 m) from the edge of excavations, or by the use of retaining devices that are sufficient to prevent materials or equipment from falling or rolling into excavations, or by a combination of both if necessary. LOCATION: The jobsite at 24 Westminster Ave. Roxbury, MA On or about July 20 2024, employees were exposed to struck-by hazards, where the employer did not ensure that excavated materials, building materials, and tools that posed hazard by falling or rolling into excavations were at least 2 feet from the edge of the excavation.
