29 CFR  1910.28(b)(1)(i):(1) Unprotected sides and edges.  (i) Except as provided elsewhere in this section, the employer must ensure that each employee on a walking-working surface with an unprotected side or edge that is 4 feet (1.2 m) or more above a lower level is protected from falling by one or more of the following:  1910.28(b)(1)(i)(A) Guardrail systems; 1910.28(b)(1)(i)(B) Safety net systems; or 1910.28(b)(1)(i)(C) Personal fall protection systems, such as personal fall arrest, travel restraint, or positioning systems.  a) On or about July 18, 2024 the employer did not ensure that employees moving products on the second level of the rack system were protected from falling while working by unprotected sides or edges measured at 8 ft. from the ground.

29 CFR  1910.178(l)(1)(ii):Prior to permitting an employee to operate a powered industrial truck (except for training purposes), the employer shall ensure that each operator has successfully completed the training required by this paragraph (l), except as permitted by paragraph (l)(5).  a) On or about July 18, 2024, the employer did not ensure that all forklift drivers have been trained prior to operating forklift trucks such as but not limited to: the Toyota-Forklift - Model 7FBCU25 (sit-down) and the Clark-Forklift - Model S25CL (sit-down) throughout the warehouse, when moving merchandise from the racks to the dock area.

29 CFR  1910.178(m)(5)(i): Truck operations. When a powered industrial truck is left unattended, load engaging means shall be fully lowered, controls shall be neutralized, power shall be shut off, and brakes set. Wheels shall be blocked if the truck is parked on an incline.  a) On or about July 22, 2024, employer did not ensure that employees moving load of product with the forklifts had the forks fully lowered and power shut off before the operator left forklift Clark-Forklift- Model  S25CL unattended at a distance of at least 25 ft. away from it.

29 CFR  1910.178(q)(7):Industrial trucks shall be examined before being placed in service, and shall not be placed in service if the examination shows any condition adversely affecting the safety of the vehicle. Such examination shall be made at least daily. Where industrial trucks are used on a round-the-clock basis, they shall be examined after each shift. Defects when found shall be immediately reported and corrected.   a) On or about July 18, 2024, the employer did not ensure that the Toyota-Forklift - Model 7FBCU25 (sit-down) with electrical wires to the lights were exposed and the lights had broken covers exposing the light bulbs and fixture holding the bulbs was also broken was removed from service until corrected.   b) On or about July 18, 2024, the employer did not ensure that the Clark-Forklift- Model  S25CL (sit-down) with a damaged seat was removed from service until corrected.  c)On or about July 18, 2024, the employer did not ensure that  the Clark Model OSX15 (green) order picker with a damaged windshield and a broken light was taken out of service, until repaired.
