OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to those hazards related to working from an elevated platform that was inadequately constructed for its attended use. a) 141 Lanza Ave Unit 29 Garfield, NJ: The employer failed to anchor the industrial steel racking system to the ground. Employees working nearby while actively stocking the system were exposed to struck-by and caught-in-between hazards due to the unanchored racking system. These issues compromised the stability of the racking system, which is used to store merchandise, such as produce. This condition was observed on or around 7/22/2024.
