29 CFR  1910.178(l)(1)(i):The employer did not ensure that each powered industrial truck operator was competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l):  a)  Yard: Employees who operated the facility's  forklifts including but not limited to the Dahmer diesel forklift, Model W31090 4WD, Serial Number 0303 044 97, were not trained per the requirements of the standard on or about 7/23/24.  NOTE: THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT CERTIFICATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.

29 CFR  1904.41(a)(1)(i) An establishment that had 20-249 employees at any time  during the previous calendar year, and was classified in an industry listed in appendix A to subpart E of this part, did not electronically submit information from OSHA Form 300A Summary of Work-Related Injuries and Illnesses to OSHA or OSHA's designee.   a)  375 State Route 34, Colts Neck NJ 07722 On or about 5/9/2024, the employer failed to electronically submit information from their 2023 OSHA Form 300A or equivalent.  The establishment employed 30 employees and was classified as NAICS 444220 during the calendar year 2023.  NOTE: THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT CERTIFICATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.
