29 CFR 1910.134(c)(2)(i): Respirator users were not provided with the information contained in Appendix D to 29 CFR 1910.134 when the employer determined that any voluntary respirator use was permissible:   a) On or about July 11,2024 - Urban Intelligence Inc., located at 154 Morgan Ave, Brooklyn, NY 11237 - Work Area  Employees painting the scaffold components are provided with half-face respirators such as but not limited to 3M 7503 elastomeric half-face respirator for voluntary use. The employees were not provided with the information contained in Appendix D of this standard.  NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM, FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1,000 AS PER 29 CFR 1903.19

29 CFR 1910.134(c)(2)(ii): The employer did not establish and implement those elements of a written program necessary to ensure that any employee using a respirator voluntarily was medically able to use that respirator, and that the respirator was cleaned, stored, and maintained so that its use does not present a health hazard to the user:  a) On or about July 11, 2024 Urban Intelligence Inc located at 154 Morgan Ave, Brooklyn NY 11237  Employees painting the scaffold components are provided with half-face respirators such as but not limited to 3M 7503 elastomeric half-face respirator for voluntary use. The employer did not provide medical evaluations by a physician or licensed health care professional (PLHCP) to qualify employees to wear respirators. 29 CFR 1910.1200(e)(1): The employer did not develop, implement, and maintain at each workplace, a written hazard communication program which described how the criteria specified in 29 CFR 1910.1200 paragraphs (f), (g), and (h) for labels and other forms of warning, safety data sheets, and employee information and training would be met.  a) On or about July 11,2024 - Urban Intelligence Inc., located at 154 Morgan Ave, Brooklyn, NY 11237 - Work Area  Employees use hazardous chemicals such as but not limited to Klean Stripe Acetone, Jasco Premium paint and epoxy remover that contains 60-70% methylene chloride, and Goof Off that contains 7-13% xylene to remove excess paint, grime or decals from the scaffold components. The employer did not maintain a written hazard communication program.  NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM, FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1,000 AS PER 29 CFR 1903.19

The employer did not maintain copies of the safety data sheets for the hazardous chemicals that employees use at the workplace. 29 CFR 1910.1200(h)(1): The employer did not provide employees with effective information and training on hazardous chemicals in their work area at the time of their initial assignment, and whenever a new physical or health hazard the employees had not previously been trained about was introduced into their work area:  a) On or about July 11,2024 - Urban Intelligence Inc., located at 154 Morgan Ave, Brooklyn, NY 11237 - Work Area  Employees use hazardous chemicals such as but not limited to Klean Stripe Acetone, Jasco Premium paint and epoxy remover that contains 60-70% methylene chloride, and Goof Off that contains 7-13% xylene to remove excess paint, grime or decals from the scaffold components. The employer did not train the employees on the hazards of the chemicals that they work with.   NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM, FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1,000 AS PER 29 CFR 1903.19
