OSH ACT of 1970 Section (5)(a)(1):  The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that the employer utilized storage rack systems with visible structural damage exposing employees to struck-by and crushing hazards:  On or about July 25, 2024, employees engaged in material handling activities at the facility located at 600 East 39th Street, Hastings, Nebraska were exposed to crushing and struck-by hazards in that the employees were operating forklifts in close proximity to damaged warehouse racking in Room 6.   The lower metal framework of the racking was bent, and three horizontal webbing beams were separated from the vertical column, creating a potential collapse of the racking system.  Employees in the area are exposed to falling pallets and structural components of the racking.      AMONG OTHER METHODS, FEASIBLE AND ACCEPTABLE ABATEMENT METHODS TO CORRECT THIS HAZARD ARE:  i.   Replace or repair any damaged columns, beams, or other structural component to restore the system to at least its original design capacity.         ii.    Install impact protection at the ends of aisles to protect racking uprights from damage.  iii    Train employees to recognize the dangers and to evaluate any hazards in regard to striking racking uprights.  iv.   Implement regular inspections of the rack system with the intent of identifying damage for repair or replacement.

29 CFR  1910.178(a)(4): Modifications and additions which affect capacity and safe operation of powered industrial truck were performed by the employer without the manufacturer's prior written approval:  On or about July 25, 2024, employees engaged in material handling activities at the facility located at 600 East 39th Street, Hastings, Nebraska were exposed to struck-by hazards in that forklifts were being operated with a safety sensor that had been bypassed. The bypassed sensor detects when the forklift operator seat is not occupied and turns the vehicle off.

29 CFR  1910.303(b)(7)(iv):  There were damaged parts that may adversely affect safe operation or mechanical strength of the equipment, such as parts that are broken, bent, cut, or deteriorated by overheating:    On or about July 25, 2024, employees engaged in material handling activities at the facility located at 600 East 39th Street, Hastings, Nebraska were exposed to electrical shock hazards from loose conduit and a missing knockout in the following instances:  i.   The light switch next to the garage door, had damage to the conduit that exposed wiring with insulation that was not designed for exposure to the elements.   ii.  The control box for the pallet inverter had conduit pulled out, exposing wiring with insulation that was not designed for exposure to the elements.
