29 CFR 1926.651(j)(2):Employees shall be protected from excavated or other materials or equipment that could pose a hazard by falling or rolling into excavations. Protection shall be provided by placing and keeping such materials or equipment at least 2 feet (.61 m) from the edge of excavations, or by the use of retaining devices that are sufficient to prevent materials or equipment from falling or rolling into excavations, or by a combination of both if necessary. a.) On or about July 25, 2024, the employer exposed employees to crushed-by hazards as they replaced water main lines in an open excavation in that the employer did not ensure the spoil pile was at least 2' from the excavation edge exposing employees to crushed-by hazards.

1926.652(b)(2) Option (2) - Determination of slopes and configurations using Appendices A and B. Maximum allowable slopes, and allowable configurations for sloping and benching systems, shall be determined in accordance with the conditions and requirements set forth in appendices A and B to this subpart. (i): Excavations are made entirely in stable rock; or (ii): Excavations are less than 5 feet (1.52 m) in depth and examination of the ground by a competent person provides no indication of a potential cave- in. a). On or about July 25, 2023, at a residential construction site, the employer failed to ensure that employees working in a 7-foot excavation were protected from cave-ins. The employer did not provide adequate protective systems, such as shoring, benching, or sloping, to prevent the walls from collapsing

29 CFR 1926.1053(b)(1):When portable ladders are used for access to an upper landing surface, the ladder side rails shall extend at least 3 feet (.9 m) above the upper landing surface to which the ladder is used to gain access; or, when such an extension is not possible because of the ladder's length, then the ladder shall be secured at its top to a rigid support that will not deflect, and a grasping device, such as a grabrail, shall be provided to assist employees in mounting and dismounting the ladder. In no case shall the extension be such that ladder deflection under a load would, by itself, cause the ladder to slip off its support. a) On July 25, 2024, the employer failed to ensure that a Werner ladder being used by an employee to ingress & egress an excavation was properly extended 3' above the walking working surface so as to assist employees from falling. As a result employees were exposed to fall hazard of 7'.
