29 CFR  1910.134(d)(1)(iii): The employer did not identify and evaluate the respiratory hazard(s) in the workplace; including a reasonable estimate of employee exposures to respiratory hazards and identification of the contaminant's chemical state and physical form:  (a)Jensen Rock & Sand, Inc. at 601 9th Avenue Southwest, Aberdeen, SD 57401:  On or about and at times prior to July 25, 2024, the employer did not evaluate the respiratory hazard associated with the process of moving Portland Cement from the trailer to the bulk silo.  This condition exposed employees to respiratory injury and illnesses associated with Portland Cement.  (b)Jensen Rock & Sand, Inc. at 601 9th Avenue Southwest, Aberdeen, SD 57401:  On or about and at times prior to July 25, 2024, the employer did not evaluate the respiratory hazard associated with chipping concrete inside the concrete truck mixer drum.  This condition exposed employees to respiratory injury and illnesses associated with Respirable Crystalline Silica.

This condition exposed employees to health hazards due to not being medically evaluated prior to respirator use.

29 CFR  1910.1053(f)(2)(i): The employer did not establish and implement a written exposure control plan:  (a)Jensen Rock & Sand, Inc. at 601 9th Avenue Southwest, Aberdeen, SD 57401:  On or about and at times prior to July 25, 2024, the employer did not ensure employees were protected from silica and/or respirable crystalline silica hazards in that no exposure control plan to prevent exposures was implemented. This condition exposed employees to respiratory hazards/injuries/illnesses.  Abatement Note: The mandatory elements are:  A description of the tasks in the workplace that involve exposure to respirable crystalline silica; A description of the engineering controls, work practices, and respiratory protection used to limit employee exposure to respirable crystalline silica for each task; and A description of the housekeeping measures used to limit employee exposure to respirable crystalline silica. The employer shall review and evaluate the effectiveness of the written exposure control plan at least annually and update it as necessary. The employer shall make the written exposure control plan readily available for examination and copying, upon request, to each employee covered by this section, their designated representatives, the Assistant Secretary and the Director.
