29 CFR 1910.94(a)(5)(iv): For employees who use respirators required by this section, the employer did not implement a respiratory protection program in accordance with 29 CFR 1910.134:  a) On or about July 29, 2024, at the Oliver Exterminating of Saint Croix, the employer did not implement a respiratory protection program where respirators were necessary to protect the health of each employee who used respirator during spray pest control operations, exposing employees to the hazards associated with inhalation of hazardous chemicals and inadequate physical/physiological capability. Employer did not provide documentation of training, medical evaluations and fit tests.   NOTE: Certification and documentation of abatement must be submitted for this citation item as required by CFR 1903.19(c) and (d), respectively.

29 CFR  1910.134(k): The employer did not provide comprehensive, understandable training which did not occur annually, and more often if necessary:  a) On or about July 29, 2024, at the Oliver Exterminating of Saint Croix, the employer did not provide training to each employee that was wearing respirators when they were necessary to protect the health of each employee while applying pesticides, exposing employees to the hazards associated with contact with these chemicals.  All provisions of 29 CFR 1910.134(k)(1) through (k)(6) shall be provided to employees wearing respirators. Key elements include, but are not limited to the following:  1) Reason for respirators use 2) Respirator limitations and capabilities 3) Effective respirator inspection and use 4) Procedures for maintenance, care and storage of respirators 5) Recognition of signs/symptoms that may limit respirator use  NOTE: Certification and documentation of abatement must be submitted for this citation item as required by CFR 1903.19(c) and (d), respectively.

29 CFR  1910.101(b):The in-plant handling, storage, and utilization of all compressed gases in cylinders, portable tanks, rail tankcars, or motor vehicle cargo tanks were not in accordance with Compressed Gas Association Pamphlet P-1-1965, which is incorporated by reference as specified in CFR 1910.6:  a) On or about July 29, 2024, at the Oliver Exterminating company, Fumigation Room, seven compressed gas cylinders containing Sulphuryl Fluoride, UN 2191 were not secured from being knocked over, exposing employees to fire and explosion hazards.
