29 CFR  1926.20(b)(2): Such programs had not provided for frequent and regular inspections of the job sites, materials, and equipment to have been made by competent persons designated by the employers.  On or about July 30, 2024, Sanchez Construction & Roofing LLC did not ensure a competent person conducted an adequate inspection of the job site, materials, and equipment to identify and correct hazards. At least one employee was observed working at 306 Burning Brook Drive in O'Fallon, Missouri. During the inspection, the employee was exposed to the following hazardous conditions:  a.)  The employer did not ensure that employees working at heights of 6 feet or greater above a lower level utilized fall protection, thus exposing employees to fall hazards. b.) The employer did not ensure that portable ladders, where used for access to an upper landing surface, were properly positioned, thus exposing employees to fall hazards.

29 CFR  1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels had not been protected by guardrail systems, safety net system, personal fall arrest system, or an alternative fall protection measure under another provision in paragraph (b) of this section, nor had the employer demonstrated that it had been infeasible or created a greater hazard to use these systems and develop and implement a fall protection plan which had met the requirements of paragraph (k) in section 1926.502.  On or about July 30, 2024, Sanchez Construction & Roofing LLC  did not ensure that each employee working from the roof of a residential building at 306 Burning Brook Drive in O'Fallon, Missouri, was protected by guardrail systems, safety net system, personal fall arrest systems, or an alternative fall protection measure under another provision in paragraph (b) of this section. At least one employee was exposed to elevated fall hazards while re-roofing a house, at heights between 9 and 20 feet, without fall protection.

29 CFR  1926.503(a)(1): The employer had not provided a training program for each employee who might have been exposed to fall hazards. The program would have enabled each employee to recognize the hazards of falling and would have trained each employee in the procedures to be followed in order to minimize these hazards.  On or about July 30, 2024, Sanchez Construction & Roofing LLC did not provide training for at least one employee who was exposed to fall hazards from re-roofing a residential building at 306 Burning Brook Drive in O'Fallon, Missouri. Employees were not trained to recognize the hazards of falling and the procedures to be followed in order to minimize fall hazards.

29 CFR  1926.1053(b)(1): When portable ladders had been used for access to an upper landing surface, the ladder side rails had not extended at least 3 feet (.9 m) above the upper landing surface to which the ladder had been used to gain access; or, when such an extension had not been possible because of the ladder's length, then the ladder would have been secured at its top to a rigid support that would not deflect, and a grasping device, such as a grabrail, would have been provided to assist employees in mounting and dismounting the ladder.  On or about July 30, 2024, Sanchez Construction & Roofing LLC did not ensure that a portable ladder used by employees to access the first-story rooftop extended at least three (3) feet (.9 m) above the edge of the upper landing surface. At least one employee was exposed to fall hazards from ascending and descending the portable ladder that was improperly positioned in a worksite at 306 Burning Brook Drive in O'Fallon, Missouri.
