29 CFR  1910.178(l)(1)(i):The employer did not ensure that each powered industrial truck operator is competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l):  a) Worksite was located at 4 Club Way, Rumson, NJ 07760.  A worker directed to operate the JLG Lull model number 1044C-54 Series II, serial number 0160038073 did so with no training on the machine to establish competency for safe operations. The operator was observed moving the Lull horizontally while another worker rode on an unsecured makeshift platform on the forks.  Violation was observed on or about July 31, 2024.  NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.

29 CFR  1926.451(c)(2)(v):The employer used forklifts  to support scaffold platforms without ensuring that the entire platform was attached to the fork and that the forklift was not moved horizontally while the platform was occupied:  a) Worksite was located at 4 Club Way, Rumson, NJ 07760.  The operator was observed moving the JLG Lull, model number 1044C-54 Series II, horizontally while another worker rode on an unsecured makeshift platform on the forks. The platform was not secured properly and was only secured to the fork attachment by a single loose nylon strap.  Violation was observed on or about July 31, 2024.  NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.

29 CFR  1926.701(b):All protruding reinforcing steel, onto and/or into which employees could fall, was not guarded to eliminate the hazard of impalement:  a) Worksite was located at 4 Club Way, Rumson, NJ 07760.  Workers working on the upper roof elevations and from ladders in the vicinity of the front porch area were exposed to impalement hazards as the rebar used in forming the concrete foundation had no caps on it.  Violation was observed on or about July 31, 2024.  NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM. 29 CFR  1926.100(a):Employees working in areas where there was a possible danger of head injury from impact, or falling or flying objects, or from electrical shock and burns, were not protected by protective helmets:  a) Worksite was located at 4 Club Way, Rumson, NJ 07760.  Workers engaged in framing, sheathing, house wrap and window hanging were exposed to struck by hazards as they were working under workers overhead with no hard hats on.  Violation was observed on or about July 31, 2024.  E N T Framing Contractors, LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 10926.100(a), which was contained in OSHA inspection number 1467925, citation number 1, item number 1 and was affirmed as a final order on March 17, 2021, with respect to a workplace located at 34 Keyes Street, Florham Park, NJ.  NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.

29 CFR  1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m)  or more above lower levels was not protected by guardrail systems, safety net systems, personal fall arrest systems, or an alternative fall protection measure under another provision of paragraph 1926.501(b), nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502:   a) Worksite was located at 4 Club Way, Rumson, NJ 07760.  A worker was working on the first floor roof elevation on the east side of the house applying house wrap membrane on the plywood sheathing with no fall protection on. The worker was exposed to a fall hazard of approximately fifteen feet to ground.  Violation was observed on or about July 31, 2024.  b) Worksite was located at 4 Club Way, Rumson, NJ 07760.  Two workers were working on the first floor roof elevation on the northeast corner framing and sheathing the gazebo porch with no fall protection on. The workers were exposed to fall hazards of approximately fourteen feet to ground.  Violation was observed on or about July 31, 2024.   E N T Framing Contractors, LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.501(b)(13), which was contained in OSHA inspection number 1467925, citation number 2, item number 1 and was affirmed as a final order on March 17, 2021, with respect to a workplace located at 34 Keyes Street, Florham Park, NJ .
