OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employee(s) in that employee(s) were exposed to fall hazards: On July 31, 2024, at 5112 Mira Way in Fargo, North Dakota, an employee was exposed to fall hazards while standing on sheets of Oriented Strand Board that was positioned on the forks of an Ingersoll-Rand VR642 rough terrain forklift at heights over 6 feet. Among other methods, a feasible and acceptable means to correct this hazard is to understand and follow the ANSI Safety Standard for Rough Terrain Forklift Trucks, B56-6.2005, section 5.15, Elevating Personnel, section 5.17, Operator Training, and section 8.24, Platforms for Elevating Personnel, which list the precautions to be taken when lifting personnel and the criteria for personnel platforms.
