29 CFR 1926.652(d)(2): Manufactured materials and equipment used for protective systems were not used in a manner that was consistent with the recommendations of the manufacturer: (a) On July 30, 2024, at 2800 13th Ave SW, Fargo, North Dakota, two employees were repairing a damaged water main in a trench greater than 7 feet where the manhole shield was assembled with two missing cross members which the tab data specifically states are required.

29 CFR 1926.652(g)(1)(iii): Employees were not protected from the hazard of cave-ins when entering or exiting the area protected by shields: (a) On July 30, 2024, at 2800 13th Ave SW, Fargo, North Dakota, two employees were repairing a damaged water main in a trench greater than 7 feet where a ladder was placed outside the manhole box in the collapse zone requiring employees to enter an inherently more hazardous area.
