29 CFR  1910.28(b)(3)(i):(3) Holes.  The employer must ensure: (i) Each employee is protected from falling through any hole (including skylights) that is 4 feet (1.2 m) or more above a lower level by one or more of the following:  a) On or about August 6, 2024, at an establishment located at 100 Woodyard Road in Niagara, Wisconsin, employees of Niagara Fabrication were exposed to slip, trip, and fall hazards from a catwalk expanded metal walkway that had an uncovered 7.5 by 6.5 inch homemade hole cut larger than 2 inches in diameter.  b) On or about August 6, 2024, at an establishment located at 100 Woodyard Road in Niagara, Wisconsin, employees of Niagara Fabrication were exposed to slip, trip, and fall hazards from a catwalk expanded metal walkway that had an uncovered 8 by 6.5 inch homemade hole cut larger than 2 inches in diameter.  c) On or about August 6, 2024, at an establishment located at 100 Woodyard Road in Niagara, Wisconsin, employees of Niagara Fabrication were exposed to slip, trip, and fall hazards from the concrete walking working surface that had a homemade hole cut larger than 2 inches in diameter.

29 CFR  1910.178(q)(7): Industrial trucks shall be examined before being placed in service, and shall not be placed in service if the examination shows any condition adversely affecting the safety of the vehicle. Such examination shall be made at least daily. Where industrial trucks are used on a round-the-clock basis, they shall be examined after each shift. Defects when found shall be immediately reported and corrected.  On or about August 6, 2024, at an establishment located at 100 Woodyard Road in Niagara, Wisconsin, forklifts were not inspected prior to being placed in service, exposing employees to potential forklift hazards.

One or more methods of machine guarding shall be provided to protect the operator and other employees in the machine area from hazards such as those created by point of operation, ingoing nip points, rotating parts, flying chips and sparks. Examples of guarding methods are-barrier guards, two-hand tripping devices, electronic safety devices, etc.  a)  On or about August 6, 2024, at an establishment located at 100 Woodyard Road in Niagara, Wisconsin, employees of Niagara Fabrication were exposed to struck-by hazards created by the rotating band saw blade on a Marvel band saw.  The employer did not guard the unused portion of the saw blade.  b)  On or about August 6, 2024, at an establishment located at 100 Woodyard Road in Niagara, Wisconsin, employees of Niagara Fabrication were exposed to struck-by hazards created by an unguarded Plasma Cutter carriage located on the production floor.
